Buying land in Suriname: fourteen checks before you sign
Anyone buying land in Suriname is buying, first and foremost, a title, not a plot of ground. This report sets out fourteen checks that a buyer, bank or civil-law notary ought to carry out before signing: from the form of title, the register and the PerceelsID to subdivision approval, nationality, heirs and costs. With statutory references, a chapter on the bank as mortgagee over grondhuur (leasehold of state land), four stylised case studies and a checklist table.
Executive Summary
Paramaribo, August 2026 · version 1.00
Anyone buying land in Suriname is buying, first and foremost, a title, not a plot of ground. The ground is there; the question is what exactly the seller is entitled to say about it, for how much longer, who else has a say in it and whether anyone else holds a claim to it that does not appear from the map or the sale agreement. Most of the disputes that PAM and SC-REAS encounter in their practice arise there: not over the price, but over the title.
This report sets out fourteen checks that a buyer, a lender or a civil-law notary ought to carry out before signing. It is written for those who deal with land professionally (banks, in-house counsel, developers) and for the private individual who buys a parcel once in a lifetime. Each check is traced back to a statutory basis and to what goes wrong in practice when the check is skipped. Where the statutory text was not consulted or provides no answer, this is stated.
The reference date of this report is 18 August 2026. Land legislation and policy are in flux; on 10 July 2026 the government announced a reform of the issue of state land. Where this may affect the conclusions, this is indicated.

Key findings
- The form of title determines everything. Freehold, grondhuur (leasehold of state land) and erfpacht (long lease) under the old law are three different assets with different terms, transfer rules and risks. In the files that PAM investigated for clients in the first half of 2026, almost two thirds of the titles were grondhuur and less than one third freehold.
- Grondhuur is an expiring right. On grant, its term is at least fifteen and at most forty years (Decreet Uitgifte Domeingrond (Decree on the Issue of State Land), art. 14 lid 3). Renewal is not automatic: it must be applied for no later than six months before expiry (art. 33 lid 1) and is granted only if the conditions are still being met (Decreet Beginselen Grondbeleid (Decree on the Principles of Land Policy), art. 9 lid 2). Anyone who fails to pay the grondhuur fee for three years or does not put the land to use risks forfeiture (art. 32 lid 1). After expiry without renewal, all that remains is a claim to compensation for improvements (art. 34 lid 1).
- The register protects only those who consult it, and not against everything. A fact that has not been registered cannot be invoked against the acquirer unless he knew of it (Burgerlijk Wetboek (Civil Code), art. 3:24 lid 1). That protection does not extend to facts that belong in the civil registry, the matrimonial property register or the estates register, to the acceptance or rejection of inheritances, or to prescription (lid 2), nor to successions that are registered within three months after the death (lid 3). The hypothecair uittreksel (register extract) costs SRD 30 and is issued within three to five working days; it says nothing about heirs, spouses or occupants.
- No registration without a PerceelsID. Instruments concerning immovable property must state the parcel identification (GLIS-wet (GLIS Act), art. 53 lid 2) and, in practice, MI-GLIS does not accept a map without a PerceelsID on a sale. On the disposal of part of a parcel, the civil-law notary may not act until a PerceelsID has been issued for the new parcels (art. 72 lid 1 and art. 73 lid 8). The survey therefore belongs before the sale agreement, not after it.
- A lot from a subdivision without the minister's approval cannot be conveyed. The civil-law notary may not execute the deed and registration is refused if the date and number of the approval are not stated in the deed (Stedebouwkundige Wet (Urban Planning Act), art. 7a leden 2 and 3).
- A bereidverklaring (letter of intent to grant) is not a title. It is the notice that the application will be granted provided conditions are met (Decreet Uitgifte Domeingrond, art. 9 lid 1). Only the decree (beschikking) and its registration within an extendable period of four months bring the right into existence (art. 10 to 12). Since August 2025, bereidverklaringen have been actively reviewed and, where necessary, withdrawn.
- Who may buy and who may sell is a check in its own right. Grondhuur is granted to Surinamese nationals resident in Suriname and to Surinamese legal entities (Decreet Uitgifte Domeingrond, art. 2); to others only with the consent of the Council of Ministers (art. 3 lid 1). On the selling side, the cooperation of the spouse and of the heirs and the authority of representatives apply.
- Transfer costs amount to approximately 5 to 9 per cent of the value. Since October 2022, stamp duty has been 4 per cent (0.5 per cent within the family up to and including the second degree); the frequently quoted 7 per cent is outdated. The major uncertain item is the civil-law notary's fee.
For whom and for what purpose
For banks: chapter 7 describes the position of the mortgagee over grondhuur; all checks marked B in Table 6 (1 to 11, 13 and 14) make up the title review before mortgage lending, of which 6, 8 and 9 apply specifically to grondhuur. For developers: chapters 4 and 8 (subdivision and sales process) and checks 7, 10 and 12 determine whether lots can be conveyed and sold. For private individuals: the checklist table in chapter 11 is intended to be taken along to the civil-law notary.
Market Context & Quantitative Data
1. Legal framework and market context
The Surinamese land system rests on a single premise: all land over which no right of ownership is proven by others is the domain of the State (Decreet Beginselen Grondbeleid (Decree on the Principles of Land Policy), S.B. 1982 no. 10, art. 1 lid 1). This decree and the Decreet Uitgifte Domeingrond (Decree on the Issue of State Land) (S.B. 1982 no. 11) are together known as the L-decrees of 1982. The burden of proof therefore lies with the citizen. State land is issued under a title in rem exclusively as grondhuur (leasehold of state land) (art. 6 lid 1); transfer of freehold by the State is the exception (art. 6 lid 4) and proceeds under the Besluit Grondconversie 2023 (Land Conversion Order 2023) (S.B. 2023 no. 159, which replaced the 2009 scheme).
The starting position therefore differs from that in the Netherlands or the United States, where freehold is the norm. In Suriname, a large proportion of inhabited land has been issued under a temporary title, subject to conditions that the State can enforce.
| Form of title | Legal basis | Term | Transfer | Principal risk for the buyer |
|---|---|---|---|---|
| Freehold (incl. allodial ownership and hereditary possession) | Burgerlijk Wetboek (Civil Code), Book 5 (S.B. 2024 no. 164, in force 1 May 2025); art. 5:1a equates allodial ownership with freehold | Unlimited | Free; notarial deed and registration (art. 3:89 BW) | Hidden attachments or mortgages; undivided estates; boundaries without PerceelsID; cooperation of the spouse |
| Grondhuur | Decreet Uitgifte Domeingrond, S.B. 1982 no. 11, art. 14 et seq. | At least 15, at most 40 years; renewal on application no later than six months before expiry (art. 33 lid 1), provided the conditions are still being met (S.B. 1982 no. 10, art. 9 lid 2) | Only with the consent of the minister, no earlier than two years after grant and only if all obligations have been fulfilled (art. 28 leden 1 and 2); fee based on the value of the bare land (S.B. 1982 no. 10, art. 10 lid 3) | Expired or nearly expired term; three years' arrears in the grondhuur fee or no utilisation within one year of issue (forfeiture, art. 32 lid 1); designated-use condition; on expiry without renewal, compensation for improvements only (art. 34 lid 1); nationality requirement (art. 2 and 3) |
| Erfpacht (long lease) and other old titles (issued before 1 July 1982) | Decreet rechtstoestand vóór 1 juli 1982 uitgegeven gronden (Decree on the Legal Status of Land Issued before 1 July 1982), S.B. 1982 no. 12 | Remaining term of the old title; no further renewal (art. 1 lid 1) | As for grondhuur (art. 6) | On expiry, the land reverts to the free domain (art. 5 lid 1); application for grondhuur still possible within one month after expiry (lid 2); land conversion possible for those who have already applied for renewal (S.B. 2025 no. 74) |
Table 1. The three forms of title in Surinamese land transactions. Source: statutory texts as stated; compiled by PAM Research & Analytics.
The register research that PAM carried out for clients in the first half of 2026 shows the distribution: approximately 65 per cent grondhuur, 32 per cent freehold and 3 per cent erfpacht or another old title. These are files for which a title investigation was requested, hence parcels coming up for transfer; the distribution says nothing about the total stock and is not a national statement. The direction is nevertheless clear: in two of the three cases investigated, the buyer is buying a temporary right. (Checks 1, 6, 9 and 10 in Table 6.)
2. The register: MI-GLIS and the hypothecair uittreksel
Since the GLIS-wet (GLIS Act) (S.B. 2009 no. 149), the Management Instituut GLIS has maintained two databases (art. 5 lid 1 onder a and b). The first is the public registers, the former function of the mortgage registry; the second is the parcel administration with the geometric database, the cadastral function. All instruments concerning immovable property are presented to the Institute for the attention of the registrar (art. 52 lid 1) and must in all cases state the parcel identification (art. 53 lid 2).
Since 1 May 2025, the new Burgerlijk Wetboek (Civil Code) has attached to this the legal consequences that buyers need to know. Conveyance of immovable property is effected by a notarial deed, followed by registration in the public registers (art. 3:89 lid 1). A fact that has not been registered cannot be invoked against the acquirer unless he knew of it (art. 3:24 lid 1). That protection does not extend to, among other things, facts that belong in the civil registry, the matrimonial property register or the estates register, the acceptance or rejection of inheritances, and prescription (lid 2), nor to successions that are registered within three months after the death (lid 3): an undivided estate or a neighbour's claim by prescription does not appear from the register and can indeed be invoked against the buyer. The acquirer is protected against incorrect registrations unless he knew or could have known of the inaccuracy (art. 3:25 and 3:26). To that end he must make reasonable efforts to establish the identity of the transferor and the actual condition of the property (art. 3:25 lid 2). That is the buyer's statutory duty of investigation.
The instrument for this is the hypothecair uittreksel (register extract): it shows the current titleholder and which rights and claims encumber the parcel, such as mortgages and attachments. The historical extract shows all mutations and previous titleholders.
| MI-GLIS product | Documents required | Cost | Processing time |
|---|---|---|---|
| Hypothecair uittreksel | Copy of parcel map (not a figurative map), copy of old extract or deed, scan of proof of identity | SRD 30 (also if the extract cannot be issued) | 3 to 5 working days after payment is credited |
| Historical extract | As above | SRD 30 plus an amount per mutation | As above |
| Certified copy of parcel map | Proof of identity, old extract or deed of conveyance | According to the schedule of fees | As above |
| Declaration of no immovable property | As specified by MI-GLIS | According to the schedule of fees | As above |
Table 2. MI-GLIS register products. Source: miglis.sr (services, hypothecair uittreksel, frequently asked questions; undated web pages, as consulted). The fees stated are those following the 20 per cent increase as of 1 April 2021, excluding payment charges.
Two practical rules. First: the extract must be recent. The Ministry of Public Works (OW) requires an extract no more than 28 days old for a subdivision application; the same standard is sensible for every purchase. Second: the extract says nothing about the actual boundary, the spouse, the heirs or the occupants. For those, the map with PerceelsID (chapter 3) and checks 2, 4 and 5 are needed. (Checks 2, 3 and 4 in Table 6.)
3. The parcel: PerceelsID, map and boundary markers
The parcel identification is "the designation of the parcel, which is unique within the national territory" (GLIS-wet (GLIS Act), art. 1 onder k) and is further regulated in the Besluit Perceelsidentificaties (Parcel Identifications Order) (S.B. 2016 no. 129). The number consists of two letters, derived from the administrative district (ressort), and two groups of four digits that encode the location. It is assigned by the GLIS surveyor after checking the map of the sworn land surveyor; MI-GLIS keeps all maps bearing a PerceelsID. Its introduction in 2017 was a response to hundreds of court cases over survey errors (Suriname Herald, 20 October 2017).
According to the MI-GLIS brochure (2023), a PerceelsID is required on a sale (including a public sale), gift or creation of a right in rem; on division, subdivision or merger; on acceptance of a bereidverklaring (letter of intent to grant); and on land conversion. For a mortgage or attachment on an existing parcel, maps without a PerceelsID are "provisionally" still accepted, with the caveat that this may change. The statutory basis for this requirement is art. 53 lid 2 GLIS-wet (instruments must state the parcel identification), elaborated in the Besluit Perceelsidentificaties, which was not consulted in this research. The GLIS-wet itself attaches no express legal consequence to its absence; in practice the registrar refuses registration (MI-GLIS brochure 2023).
On a split, the law goes further. On the disposal of part of a parcel, the titleholder must instruct a sworn land surveyor to form the parcels (art. 72 lid 1), and the civil-law notary may not act until the parcel identification has been issued for the newly formed parcels (art. 73 lid 8). Only the surveyor can submit the application; the titleholder cannot.
| Step | Who | Formal standard | Practice (sources 2019–2025) |
|---|---|---|---|
| Survey and map in accordance with the Surveyors' Instructions | Sworn land surveyor | Under the direct management or supervision of a sworn land surveyor | Maps issued for parcels without boundary markers in place and with overlapping boundaries have been documented (Starnieuws, 20 April 2021); complaints against surveyors are handled by the Disciplinary Board (GLIS-wet, art. 49; Sun.sr, 28 August 2025) |
| Application to MI-GLIS | Surveyor | Application fee SRD 60; application number; status online | Surveyor's fee unregulated; MI-GLIS has no influence over it |
| Review and assignment | GLIS surveyor | Within two weeks for a complete application | Waiting times of months reported (Starnieuws, 19 March 2019); capacity pressure on surveyors and MI-GLIS owing to approximately 40,000 grondhuur parcels (Key News, 21 March 2024); second GLIS surveyor appointed. Current processing time not verified. |
| No PerceelsID in the event of a boundary dispute | MI-GLIS | Only after judgment | A purchase with a pending boundary dispute is therefore in practice not conveyable |

For the buyer this means: the survey is not a final step but a precondition. Anyone who signs a sale agreement on the basis of a 1978 map without a PerceelsID is signing on a document that the registrar will not register. The correct order is: survey first, then buy. The survey should include a check in the field as to whether the boundary markers are actually in place, whether the neighbours recognise the same boundary and who actually uses the parcel; in the survey practice of SC-REAS, discrepancies of several decimetres at a fence come to light only at the time of the survey. (Checks 4 and 5.)
4. Subdivision: the minister's approval
In areas with an adopted structure plan and in the residential areas designated by state order, land may be subdivided only in accordance with a subdivision plan approved by the minister (Stedebouwkundige Wet (Urban Planning Act), G.B. 1972 no. 96, art. 7 lid 1). According to the Handleiding Verkavelingen 2022 (Subdivision Manual 2022), the designated areas are Greater Paramaribo, Wanica, Commewijne, Para, Nickerie and Apoera. Article 7a makes that rule watertight throughout the chain. The surveyor issues no survey certificate without a declaration on the approval (lid 1). The civil-law notary may not execute the deed unless the approval has been shown to him (lid 2). Registration is refused if the date and number of the approval are not stated in the deed (lid 3). Subdividing in breach of art. 7 is an offence (art. 18 lid 1 onder a: detention of up to three months or a fine).
The Handleiding Verkavelingen 2022 of the Ministry of Public Works (OW) describes the application (form AF-02 at the One Stop Window) and the documents required. These are: petition, hypothecair uittreksel (register extract) no more than 28 days old, parcel map, division map, site plan, subdivision plan RL-01 to RL-04, cross-section RL-05, spot-height and soil map, declaration on the transfer of road and water strips, and digital drawings. For a family subdivision of up to ten parts, minimum requirements apply: lot width 15 metres, lot area 350 m² and road widths of 10, 12.5 or 15 metres. The minister decides within four months of submission (art. 8 lid 2). For state land, the approval of the Ministry of Public Works is followed by the consent of the Ministry of Land Policy and Forest Management (GBB), because grondhuur (leasehold of state land) may not be divided without the consent of the State (Decreet Uitgifte Domeingrond (Decree on the Issue of State Land), art. 19 lid 1).
For the buyer of a lot, the check is simple: ask for the date and number of the subdivision approval and have the civil-law notary verify them. Also ask whether the road and water strips have been transferred to the State or how access to the lot is otherwise secured. A "lot" for which the approval number is missing is not an independent parcel in property law: it cannot be conveyed and the buyer is left with nothing more than a claim against the seller. What a developer's sales process should look like instead is set out in chapter 8. (Check 7.)
5. State land, bereidverklaringen and who may buy
Under the law, a bereidverklaring (letter of intent to grant) is the minister's notice that the application will be granted, provided the land is surveyed and demarcated and the costs are paid (Decreet Uitgifte Domeingrond (Decree on the Issue of State Land), art. 9 lid 1). If this is not done within the period set, the application is deemed to have lapsed (art. 9 lid 2). Only then does the minister grant the application by decree (beschikking) (art. 10); the decree must be presented for registration within a period of four months, extendable by the minister (art. 11 lid 1), and the right comes into existence through that registration (art. 11 lid 2). A decree not presented in time lapses by operation of law (art. 12). A bereidverklaring is therefore not a right in rem and cannot be transferred as such; even a genuine grondhuur decree that was never registered has not brought grondhuur (leasehold of state land) into existence.
To this is added the question of who may acquire grondhuur. State land is granted to Surinamese nationals resident in Suriname and to legal entities incorporated under Surinamese law and established in Suriname (art. 2 onder a and b). To others, state land may be granted only with the consent of the Council of Ministers (art. 3 lid 1); foreign nationals who leave Suriname to take up residence elsewhere are declared to have forfeited the right (art. 3 lid 2). For heirs who do not meet the requirements of nationality or residence, the loss of the right (art. 16 lid 2) is suspended for one year after the estate opens (art. 17). For the transfer of existing freehold between private parties, no nationality requirement was found in this research; MI-GLIS does, however, ask for a declaration of nationality from the parties on every transfer. For a buyer from the diaspora holding a foreign nationality, this is not a risk but a limit: as a rule, grondhuur cannot be put in his name, as the Dutch notarial profession also notes (Notariaat Magazine, November 2018).
Policy on bereidverklaringen has been tightened since August 2025. The Minister of GBB announced that "all dubious land grants from the recent past will be suspended or reversed" and set up a legal intervention team (Starnieuws, 19 August 2025; Waterkant, 20 August 2025). Issuing a second bereidverklaring while the first is still current is not permitted; only grants made outside the statutory procedure in the past five years qualify for annulment; bona fide holders are not affected (Suriname Herald, 15 November 2025). In 2026 there followed withdrawals of bereidverklaringen along the road to Apoera (Starnieuws, 19 April 2026), an investigation into grants in nature reserves (Starnieuws, 30 June 2026) and into four grants around police service housing, two of which had already been converted to freehold (Suriname Herald, 6 July 2026). In July 2026 a sworn land surveyor pointed out that the lack of publication of applications is the source of double grants (Starnieuws, 8 July 2026).
On 10 July 2026 the president announced a reform. According to her, the forty-year term has been abused "to get hold of citizens' homes and parcels". Transfer and renewal are to go directly through the civil-law notary and the Dienst der Domeinen (State Lands Office), unused land is to revert and the general designated use "housing and building" is to be abolished (Suriname Herald and gov.sr, 11 July 2026). The legislation is in preparation; until it is in place, the 1982 decrees apply in full.
The examples from press reports show the same pattern. A land inspector was arrested over an advisory report "contrary to the truth" (gov.sr, 22 September 2023). The district commissioner of Commewijne warned against buying parcels in Zoelen and Mariënburg because of conflicts between tenants and allottees (Key News, 4 November 2023). A woman reported fraud after an advance of USD 800 for an "arranged" bereidverklaring (Suriname Herald, 30 March 2025). The common denominator is always the same: payment was made for an expectation, not for a registered right. (Checks 8 and 13.)
6. The costs of transfer
Since the amendment of the Zegelwet (Stamp Act) (S.B. 2022 no. 119, promulgated 6 October 2022 and in force the following day), stamp duty has been 4 per cent of the value of the immovable property. On transfer to family up to and including the second degree, it is 0.5 per cent of the value of the rights in rem. Mortgage deeds are exempt from this rate. The explanatory memorandum states that the aim is to stimulate transactions; the rate was previously 7 per cent. The frequently asked questions on the MI-GLIS website still state 7 per cent; that figure is outdated.
| Cost item | Legal basis | Rate | Source |
|---|---|---|---|
| Stamp duty (transfer tax) | Zegelwet, art. 32 (S.B. 2022 no. 119) | 4% of the value; 0.5% within the family up to and including the second degree; on exchange 4% on half the value; not payable on mortgage deeds | dna.sr |
| Registration MI-GLIS | MI-GLIS schedule of fees | Approximately 0.5 to 0.6% of the purchase price | MI-GLIS (frequently asked questions); Key News (2 September 2022) |
| Civil-law notary | Wet Notarisambt 2019 (Notarial Profession Act 2019), art. 71 (fee by state order; order not found) | Up to 3% of the purchase price according to MI-GLIS; within the family approximately half; in practice agreed between the parties | MI-GLIS (frequently asked questions); Notariaat Magazine (2018) |
| Valuation report (no more than one year old) | MI-GLIS requirement | Approximately 0.2% of the value | MI-GLIS (frequently asked questions) |
| Extracts and PerceelsID | MI-GLIS schedule of fees | Extract SRD 30; PerceelsID application SRD 60; sworn land surveyor's fee unregulated | MI-GLIS (brochure 2023) |
| For grondhuur: fee to the State for consent to transfer | S.B. 1982 no. 10, art. 10 lid 3 | Based on the value of the bare land; amount not public, to be requested from GBB in advance | sris.sr |
| For grondhuur: annual grondhuur fee (reassessed after renewal) | Besluit Grondhuurvergoeding 2023 (Grondhuur Fee Order 2023) (S.B. 2023 no. 50) | Residential SRD 1.50 to 2.00 per m² per year from 500 m²; commercial SRD 2.50; industrial SRD 3.00; collected by MI-GLIS since 1 January 2024 | sris.sr; S.B. 2024 no. 9 |
| On land conversion to freehold (not a transfer cost, but often part of the transaction) | Besluit Grondconversie 2023 (Land Conversion Order 2023) and amendment S.B. 2024 no. 157 | Conversion value in the first year SRD 25 per m² (residential, agricultural) or SRD 50 per m² (commercial, industrial); civil-law notary's costs by area class | sris.sr |
| Fill and connections | No statutory basis; practice | Dependent on elevation relative to road level; in Greater Paramaribo a substantial part of the land value | Handleiding Verkavelingen 2022 (spot-height map, RL-05) |
Table 4. Costs on transfer and ownership. The Zegelwet refers to "value", not purchase price; in practice the appraised value is used, verified by the registrar. Amounts in SRD. Compiled by PAM Research & Analytics.
Work it out yourself. Enter a purchase price below and choose market or family and freehold or grondhuur; the calculator shows the costs according to the tariffs in Table 4.
In total, a regular transfer comes to approximately 5 to 9 per cent of the value, depending mainly on the civil-law notary's fee; Key News calculated approximately 9 per cent in 2022. A family transfer comes to approximately 3 to 5 per cent. Anyone settling in euros or US dollars must budget these costs in SRD at the exchange rate on the date of the deed; for payment from abroad, the civil-law notary applies for a foreign exchange licence, the processing time of which belongs in the planning. (Checks 12 and 14.)
Analysis & Methodology
7. The bank as mortgagee over grondhuur
A bank that takes a mortgage over grondhuur (leasehold of state land) takes security over a right that can expire, can be forfeited and can be revoked. The Decreet Uitgifte Domeingrond (Decree on the Issue of State Land) regulates that position in part.
Creation. The grondhuur holder is entitled to dispose of his right and to create rights in rem over it (art. 18 lid 2). No ministerial consent for the creation of a mortgage was found in the statutory text; the consent requirement of art. 28 applies to transfer. On a sale in execution, no consent to transfer is required (art. 28 lid 3), which simplifies enforcement for the bank; but the fee to the State (art. 28 lid 1; S.B. 1982 no. 10, art. 10 lid 3) must be paid out of the execution proceeds and therefore ranks ahead of the bank's recovery. The forced-sale value (operating rule 3) should be adjusted accordingly. For the creation of a mortgage over an existing parcel, MI-GLIS provisionally still accepts a map without a PerceelsID, but has announced that this may change (chapter 3).
Forfeiture for non-performance (art. 32). The minister may declare the right forfeited in whole or in part if the grondhuur holder fails to comply with the conditions, does not put the land to use within one year or fails to pay the fee for three consecutive years (lid 1). This takes place no earlier than four weeks after a notice of default served by bailiff's writ, unless the shortcomings have been remedied in the meantime (lid 4). The writs under lid 2 (the forfeiture itself) and lid 3 are also served on mortgagees (lid 5); the notice of default under lid 4 is not mentioned in lid 5. The bank therefore cannot count on receiving the notice of default and making use of the four weeks; it may learn of the forfeiture only once it has already been pronounced. After registration of the forfeiture, the land reverts to the free domain free and unencumbered (lid 7): the mortgage is extinguished. The bank's own monitoring of payment status (operating rule 2) is therefore the only reliable protection.
Forfeiture in the public interest (art. 31). If the State needs the land, the land likewise reverts free and unencumbered (lid 3), but the grondhuur holder is entitled to compensation, including for improvements (lid 5), and the mortgagee is paid out of it with priority and according to rank (leden 7 and 8).
Expiry of the term (art. 34). If the right ends through expiry of the term, the former grondhuur holder is entitled to compensation equal to the value of the improvements (lid 1), with the exception of structures that can be removed without appreciable damage (lid 2). This article says nothing about the mortgagee. A bank would therefore be well advised to have that claim pledged or assigned at the time of lending, so that on expiry without renewal it has recourse at least to the compensation for improvements.
Four operating rules for acceptance policy follow from these provisions:
- Loan term no longer than the remaining grondhuur term less a renewal buffer; with a remainder of less than ten years, finance only against a renewal decree.
- Check the payment status of the grondhuur fee on acceptance and annually thereafter (MI-GLIS, grondhuur online); two years' arrears is a warning sign, three years is a ground for forfeiture.
- Estimate the forced-sale value of grondhuur on the remaining term excluding renewal, unless the renewal decree is in hand, and less the fee to the State paid out of the execution proceeds; the valuation report must state the term, payment status and consent status.
- Agree with the debtor that every notice of default is passed on to the bank without delay, and act within the four-week period on every writ that the bank does receive.

8. The developer's sales process
For larger subdivisions, the Handleiding Verkavelingen 2022 (Subdivision Manual 2022) provides a different route from that for the family subdivision: intake, quick scan, processing and a bereidverklaring (letter of intent to grant) from the Ministry of Public Works (OW). The works must then be carried out within one year; the permit follows only once execution has been fully approved, including laboratory results. The lots are therefore conveyable only once the infrastructure has been constructed and approved. From this follows a fixed sequence for the sale, in which law and practical advice are kept separate.
| Phase | What is permitted (law) | What is sensible (practice) |
|---|---|---|
| Permit phase (plan submitted, no approval) | No conveyance: surveyor, civil-law notary and registrar are bound (Stedebouwkundige Wet (Urban Planning Act), art. 7a) | Reservations or options only; every amount in escrow with the civil-law notary subject to a repayment clause; advertising only with the statement "subject to subdivision approval" |
| Approval granted (date and number known) | Sale agreements possible; for state land also GBB consent (Decreet Uitgifte Domeingrond (Decree on the Issue of State Land), art. 19 lid 1) | Approval number in every sale agreement; deposit in escrow until conveyance; specify a period for execution of the works |
| Works executed and approved; permit granted | PerceelsID per lot (GLIS-wet (GLIS Act), art. 72 and 73); conveyance by notarial deed stating the approval number (art. 7a lid 3) | Transfer the road and water strips or secure access as a right in rem before the first conveyance |

9. Four stylised case studies
The cases below are composed from recurring patterns in the register research of PAM and SC-REAS; locations and amounts are stylised and cannot be traced to an actual file.
Case A. Freehold parcel in Paramaribo-Noord, map from 1978
The seller produces a deed of conveyance and a surveyor's map from 1978. The parcel is built on; the fence has stood there for decades. The hypothecair uittreksel (register extract) shows no mortgage or attachment. The buyer wants to sign quickly.
Check: the map has no PerceelsID; in practice the registrar does not register the deed without a parcel identification (GLIS-wet (GLIS Act), art. 53 lid 2; MI-GLIS practice, brochure 2023). Moreover, no one has asked about the building permit for the structures. Outcome: on survey, the fence on one side proves to stand approximately a quarter of a metre inside the title boundary; the neighbour obtained a PerceelsID in 2015 on the basis of the fence. From here there are two paths. If the neighbour recognises the title boundary, his PerceelsID is corrected by means of a new relaas van bevinding (surveyor's report of findings) and an agreement between both owners; that takes three months. If he refuses, there is a boundary dispute, MI-GLIS issues no PerceelsID until there is a judgment, and the parcel cannot be conveyed. Had the buyer had the parcel surveyed before the sale agreement, the price would have been adjusted accordingly or the purchase would not have proceeded.
Case B. Grondhuur parcel in Wanica, term expires in three years
The decree dates from 1989, with a term of forty years. The seller has not paid the grondhuur (leasehold of state land) fee since 2022, now four years. He is asking a price equal to that of comparable freehold parcels.
Check: four matters at once. (1) The arrears exceed the three-year threshold (Decreet Uitgifte Domeingrond (Decree on the Issue of State Land), art. 32 lid 1 onder c); the first question is whether a notice of default has already been served or a forfeiture is in preparation. (2) Transfer requires the consent of the minister (art. 28 lid 1), which is refused as long as the grondhuur holder has not fully performed his obligations (art. 28 lid 2). (3) Renewal must have been applied for no later than six months before expiry (art. 33 lid 1) and is granted only if the conditions are still being met (Decreet Beginselen Grondbeleid (Decree on the Principles of Land Policy), art. 9 lid 2); a grondhuur holder in arrears does not meet them. (4) The alternative: land conversion to freehold (Besluit Grondconversie 2023 (Land Conversion Order 2023), as amended by S.B. 2024 no. 157), for which the application requires, among other things, a receipt for the last grondhuur fee paid (art. 4 lid 3); the arrears must therefore be settled first. Were the term already to have expired, conversion has since May 2025 also been open to those who have applied for renewal but not yet obtained it (S.B. 2025 no. 74).
Outcome: the buyer has the seller settle the arrears at MI-GLIS, apply for renewal and preferably complete the conversion to freehold before conveyance, so that he buys freehold instead of an expiring right. If that is not achieved, the value of the temporary right is derived from the remaining term, the renewal risk, the grondhuur fee and the compensation for improvements on expiry (art. 34 lid 1), and the forced-sale value from the remaining term excluding renewal. As a rule, a bank will accept the parcel as security only after renewal or conversion.
Case C. Lot in a family subdivision, "approval on its way"
A family divides a parent parcel into eight lots and sells two of them to third parties. There is a neatly drawn division map; the seller says the approval of the Ministry of Public Works (OW) will arrive "any moment".
Check: without the date and number of the ministerial approval in the deed, registration is refused (Stedebouwkundige Wet (Urban Planning Act), art. 7a lid 3). Sale to third parties moreover raises the question of whether it is still a family subdivision and which requirements then apply. Outcome: the buyer pays a deposit directly to the seller and waits fourteen months; the plan proves to have been rejected because the lot width was below 15 metres and the access road was narrower than 10 metres. The deposit is a claim against a seller who has already spent the money. Here too, the sequence of chapter 3 applies: first the approval, then the purchase; at most an option with the amount in escrow with the civil-law notary and a repayment clause, never a purchase price.
Case D. Grondhuur from an estate, buyer from the diaspora
The registered grondhuur (leasehold of state land) holder died in 2019. Six children are heirs, two of whom live in the Netherlands. A cousin in Paramaribo "arranges the sale" to a buyer of Dutch nationality, who pays in euros.
Check: the hypothecair uittreksel (register extract) still shows the deceased; the register does not show the heirs and the buyer acquires only from those who are jointly entitled to dispose. Art. 3:24 BW offers no protection here: lid 1 does not apply to successions that are registered within three months after the death (lid 3), nor to the acceptance or rejection of inheritances (lid 2). What is needed is a certificate of inheritance, the cooperation of all six co-heirs or legalised powers of attorney from the two in the Netherlands, and the minister's consent to transfer. In addition, the buyer's nationality: grondhuur is granted to Surinamese nationals resident in Suriname (Decreet Uitgifte Domeingrond (Decree on the Issue of State Land), art. 2); to others only with the consent of the Council of Ministers (art. 3 lid 1). For the heirs in the Netherlands too, the loss of the right was suspended for only one year after the estate opened (art. 17). Outcome: the purchase in this form is incapable of performance. The viable routes are: the heirs convert the parcel to freehold (residential designated use, at most two hectares) and then sell freehold, for which no nationality requirement was found in this research; or a Surinamese legal entity buys, which must be reviewed separately in tax and legal terms. For long-undivided estates, the new BW has moreover offered a judicial route since 1 May 2025 whereby ownership passes by registration of the court order (art. 3:200a to 3:200i; as described in the legal literature, see chapter 10). The payment in euros goes through the civil-law notary, who applies for the foreign exchange licence.
10. Methodology and limitations
This report is based on the primary statutory texts as published on sris.sr, dna.sr and miglis.sr, on the MI-GLIS brochure and frequently asked questions, and on the Handleiding Verkavelingen 2022 (Subdivision Manual 2022) of the Ministry of Public Works (OW). In addition, reporting by gov.sr, Starnieuws, Suriname Herald, Key News, Waterkant and Sun.sr up to and including 18 August 2026 has been incorporated. The article numbering of the Decreet Uitgifte Domeingrond (Decree on the Issue of State Land) follows the text on sris.sr with the amendments up to 2003; later amendments have not been checked. The distribution by form of title comes from PAM's own register research for the first half of 2026; it concerns files for which clients requested a title investigation; the series is not representative of the stock, and in accordance with PAM's publication policy no absolute numbers are published.
Not consulted or not found are: Book 5 of the new Burgerlijk Wetboek (Civil Code) (the account of art. 5:1a rests on NJB 2025/800 and Ars Aequi, October 2025), Book 1 (matrimonial property law and consent of the spouse) and Book 7 (tenancies on transfer). Likewise not consulted are articles 3:200a to 3:200i (the account rests on Akkal-Ramautar 2025 and NJB 2025/800) and the mortgage articles of Book 3, the Besluit Perceelsidentificaties (Parcel Identifications Order) (S.B. 2016 no. 129), the state order on the civil-law notary's fee (art. 71 Wet Notarisambt (Notarial Profession Act)), the MI-GLIS schedule of fees, the Deviezenregeling (Foreign Exchange Regulation) and the rules of the Deviezencommissie (Foreign Exchange Commission), and the Bouwwet (Building Act). The MI-GLIS web pages are undated; fees and processing times may have changed. No case law was consulted and no verification was carried out with MI-GLIS or the notarial profession. The legislative amendment announced in July 2026 may change the rules on transfer, renewal and designated use of grondhuur (leasehold of state land); this report describes the law as at the reference date.
Strategic Scenarios
11. The fourteen checks
The table is intended as a working document. For each check it states the document, who supplies it, the question that must be answered and what a "no" means. The last column indicates for whom the check is indispensable: B = bank, D = developer, P = private individual.
| # | Check | Document | Supplied by | The question that must be answered | If "no" | For |
|---|---|---|---|---|---|---|
| 1 | Form of title | Deed of conveyance or grondhuur decree (beschikking); for grondhuur (leasehold of state land): has the decree been registered (Decreet Uitgifte Domeingrond (Decree on the Issue of State Land), art. 11 lid 2)? | Seller; MI-GLIS | Freehold, grondhuur or old title? What designated use is stated in the decree? | Stop until the title is established | B D P |
| 2 | Titleholder, authority and marital status | Hypothecair uittreksel (register extract) (preferably no more than 28 days old); proof of identity; civil registry extract; for a legal entity: Chamber of Commerce extract and authority under the articles; powers of attorney legalised | Seller; MI-GLIS; civil-law notary | Is the seller the registered titleholder? Married, and does the spouse cooperate? Validly represented? | Stop | B D P |
| 3 | Encumbrances and history | Hypothecair uittreksel and historical extract | MI-GLIS | Mortgage, attachment, easement? Earlier transfers without consent? Pending disputes? | Condition: cancellation or settlement before conveyance | B D P |
| 4 | Heirs and estate | Certificate of inheritance; cooperation of all co-owners; for a long-undivided estate: court order (BW, art. 3:200a–200i) | Seller; civil-law notary | Is the registered titleholder still alive? If not: are all heirs known and do they cooperate? | Stop until the estate has been settled | B D P |
| 5 | Parcel, boundaries and actual use | Map with PerceelsID; field check of boundary markers; survey of occupation and use | Sworn land surveyor; MI-GLIS | Is there a PerceelsID? Are the markers in place? Do the neighbours recognise the boundary? Who uses or occupies the parcel, and under what title? | Stop: survey first; not conveyable in the event of a boundary dispute | B D P |
| 6 | Grondhuur term | Decree; renewal decree | GBB; MI-GLIS | Remaining term? Renewal applied for no later than six months before expiry, and granted? | Condition: renewal or conversion before conveyance; bank: loan term shorter than the remainder | B P |
| 7 | Subdivision and access | Subdivision approval with date and number; for state land, GBB consent; declaration on road and water strips | Ministry of Public Works (OW); Ministry of Land Policy and Forest Management (GBB) | Did the lot arise from an approved plan? Is access secured as a right in rem? | Stop: not conveyable; at most an option with escrow | B D P |
| 8 | Consent to transfer (grondhuur) | Ministerial decree | GBB | Consent granted? Two years since grant elapsed? All obligations fulfilled? Bare-land fee known? | Stop until consent has been obtained | B P |
| 9 | Grondhuur fee | Receipt for the last fee paid | MI-GLIS (grondhuur online) | Arrears? Notice of default served? | Condition: settle before conveyance; three years' arrears is a ground for forfeiture | B P |
| 10 | Designated use and utilisation | Decree; change of designated use | GBB | Does the intended use fit the designated use? Was the land put to use within one year of issue? For commercial or industrial use: soil and environmental history? | Condition: apply for a change of designated use | B D P |
| 11 | Buildings | Building permit; valuation report with permit status | Seller; Ministry of Public Works; valuer | Are the buildings permitted? Deviations identified? | Condition: legalisation or price adjustment; bank: do not finance without reservation | B P |
| 12 | Elevation and drainage | Spot-height map; cross-section (RL-05); field survey | Land surveyor | Does the parcel lie above road level? How is drainage arranged? Fill costs estimated? | Price adjustment | D P |
| 13 | Nationality and residence of the buyer | Declaration of nationality; for grondhuur: review against art. 2 and 3 Decreet Uitgifte Domeingrond | Buyer; civil-law notary | Can the buyer acquire grondhuur in this capacity? | Stop: alternative is freehold (after conversion) or a Surinamese legal entity, to be reviewed separately | B P |
| 14 | Costs and currency | Valuation report (no more than one year old); cost estimate; for payment from abroad: foreign exchange licence | Valuer; civil-law notary | Have stamp duty (4%; 0.5% within the family), civil-law notary, MI-GLIS, valuation and fill been budgeted in SRD at the exchange rate on the date of the deed? | Adjust the budget | B D P |
Table 6. Fourteen checks before signing. Compiled by PAM Research & Analytics; legal bases in chapters 1 to 8. Checks 2 (spouse), 11 (buildings) and 12 (elevation) rest on the practice of the notarial profession, valuation and land surveying; Book 1 BW and the Bouwwet (Building Act) are not cited in this research.
11.1 What the announced reform may change
If the legislation announced in July 2026 is adopted as described, three checks shift. Check 8 becomes simpler: transfer via civil-law notary and the Dienst der Domeinen (State Lands Office) instead of a ministerial signature. Check 10 becomes heavier owing to the abolition of the general designated use "housing and building" and the automatic reversion of unused land. Check 6 takes on a different content if the forty-year term is abandoned. Until that legislation is in place, the table remains unchanged.
Conclusion
12. Conclusion
In Suriname, the title is the product. The fourteen checks in this report are not formalities. Each of them corresponds to a statutory provision. Where it is omitted, that provision blocks the conveyance (PerceelsID, subdivision approval, consent), may cause the title to be forfeited (grondhuur fee, use, term), leaves the buyer with a claim instead of a parcel (bereidverklaring (letter of intent to grant), deposit paid before approval) or renders the purchase incapable of performance (nationality, heirs, spouse).
For banks, the most important lesson is that a mortgage over grondhuur (leasehold of state land) is extinguished on forfeiture and that the law gives the mortgagee no position on expiry of the term; the four operating rules in chapter 7 are the answer to this. For developers: the approval of the Ministry of Public Works (OW) is the starting point of the sale, and buyers' money belongs in escrow with the civil-law notary until conveyance. For private individuals: anyone who invests SRD 30 and five working days in a hypothecair uittreksel (register extract), has the parcel surveyed before the purchase and asks about the heirs and the spouse avoids the disputes described in this report.
PAM Research & Analytics carries out register investigations and title reviews for banks, developers and private individuals; surveys and parcel identification are carried out by the affiliated company SC-REAS N.V.
